Gurugram, Nov 3 Police have filed a chargesheet against two men for attempt to murder and other offences after they allegedly rammed their car deliberately into female biker Shivani Chauhan on September 13, officials said on Tuesday.
The charge sheet was filed against Kalyan Baisla and Lavnish in a local court, they said.
A court took cognisance of the chargesheet on Monday, the officials said.
The incident, captured on a helmet-mounted camera worn by Shivani as well as on a camera belonging to a fellow biker, sparked outrage after she shared the video on social media.
Shivani alias Siya, a 27-year-old resident of Kalkaji in Delhi, was travelling with her friends from Golf Course Road towards Extension Road when the accused, who was in a white car, allegedly followed them, made obscene gestures, and then rammed his vehicle into her motorcycle from the side before fleeing the scene. The impact knocked her off and sent her skidding on the road.
Following his arrest, Kalyan had admitted the collision was his fault but denied hitting her deliberately, claiming he “lost control near a U-turn”.
However, a Special Investigation Team (SIT) report had concluded that “this was not an accident, but a calculated, intentional act”.
“To strengthen the case, the police examined CCTV footage from over 15 locations and included it in the charge sheet.
“This includes footage from GMDA and DLF cameras, as well as footage from a dashcam mounted on the complainant (female biker) and from a camera belonging to a club,” said a senior investigating officer.
There were four people in the car. Kalyan and his cousin Lavnish were in the front.
According to the police, the accused were booked under sections 78 (physical and digital stalking), 79 (use any word, sound, gesture, object, or intrusion of privacy with the intent to insult the modesty of a woman), and 109 (attempt to murder) and 3(5) (common intention) of the BNS.
Following a notice from the Haryana Commission for Women, Police Commissioner Sibash Kaviraj constituted the SIT. On September 15, Gurugram Police arrested Kalyan Baisla and Lavnish from Rajgarh in Dausa, Rajasthan.
Both are currently lodged in Bhondsi Jail, Gurugram, after their bail pleas were rejected.
“Initially, this incident appeared to be a routine accident, but the footage and facts that emerged during the investigation changed the entire narrative. The footage clearly shows that the collision was not accidental, but deliberate.
“Based on other evidence gathered during the investigation, the police also invoked relevant legal provisions in the case,” said a senior police officer.
