New Delhi, Oct 24 A plea was filed in the Supreme Court on Saturday seeking guidelines for the collection of personal data and furnishing of digital data in the course of an investigation.

The plea has sought the formulation of comprehensive, constitutionally compliant safeguards to regulate the exercise of investigative powers involving access to personal and digital information.

“The present proceedings arise from the necessity of establishing a legally enforceable framework governing the collection, requisition, preservation, examination, processing and use of personal digital data by investigating agencies.

“In the contemporary digital environment, mobile phones, electronic devices, social media accounts, cloud storage and other digital platforms contain an extensive repository of an individual’s private life, including personal communications, location history, professional interactions, confidential information and associational details,” the plea filed by journalist Abhishek Upadhyay said.

The plea, filed through advocate Anoop Prakash Awasthi, contended that unrestricted or disproportionate access to such information may reveal considerably more information than is necessary for investigating a particular offence, thereby resulting in an impermissible intrusion into constitutionally protected privacy.
